User Agreement of Destarion Website

The Internet resource Destarion, located at https://destarion.com/, contains information about video games, their creators, and news from the gaming industry.

Use of the Website is permitted only upon full and unconditional acceptance of the terms of this User Agreement.

A User who fully or partly disagrees with these terms must immediately cease any use of the Website.


1. Terms and Definitions

For the purposes of this User Agreement, the following terms shall have the following meanings:

Website Administration — holds all exclusive proprietary rights to the Website (including its domain name), the materials posted on the Website, and performs its administration and management.

Database — the collection of Information posted on the Website. All Information posted on the Website, as well as its selection, grouping, and arrangement, constitute the intellectual property of the Website Administration and/or other rights holders.

Information — any content posted by the User or the Website Administration on the Website, including: User's Personal Information, links to other sites, text posts, game reviews, comments, images, audio/video works, computer programs, and other files.

Moderation — altering or deleting any Information present on the Website, including that added by the User.

User — any individual using the Website. A User who completed registration and received a login and password is a registered user and has a Profile. Any User accessing or using the Website automatically agrees to this User Agreement.

User-generated content — any content (text, video, image, reviews, feedback, comments, etc.) created by Users and posted on the Website.

Profile (account) — a special section of the Website protected by a password, containing User-provided information. Each User is entitled to only one Profile.

Personal Information — any data voluntarily provided by the User during registration or use of the Website, including personal data and information automatically transmitted during use, such as IP address, cookies, browser data, and other device-related information.

Website — the internet resource at https://destarion.com/. Depending on context, this may also refer to the Website’s software, design, database, any section/subsection, and information posted by both the Website Administration and Users. All proprietary rights belong to the Website Administration.

Spam — unsolicited advertising, informational, or promotional distributions.

Any terms not defined in this section shall be interpreted according to their ordinary meaning as derived from this Agreement. In case of ambiguity, interpretation by the Website Administration shall prevail.


2. Subject and General Provisions

This User Agreement (hereinafter referred to as the “Agreement” or “Rules”) sets forth the terms and conditions of use of the Website and the posting of Information on it, and constitutes a contract between the User and the Website Administration, replacing all previous agreements between the User and the Website Administration.

Access to the Website, use of the Website, and/or performing any other actions on the Website by the User signifies that the User accepts and agrees to comply with all terms of this Agreement. Completion of the User registration procedure on the Website also signifies the User’s acceptance of this Agreement.

The Website Administration reserves the right at any time and on any grounds, without prior notice or obligation, to:

Restrict Users' access, limit or terminate access to the Website;

Refuse, on any grounds, to post, move, or delete any materials on the Website;

Block or delete User accounts, as well as remove or delete any information contained in User account files.

By accepting this User Agreement, the User confirms that the Website Administration bears no responsibility to the User or any other party for carrying out any of the actions mentioned in this Agreement.

The User understands and agrees that the use of the Website may be accompanied by advertisements, and that such advertising is necessary for the operation of the Website. The User also agrees not to block, alter, or restrict the display of such advertisements by modifying HTML/CSS or by any other means. By using the Website, the User acknowledges the Website Administration's right to display such advertisements without prior notice and without any compensation to the User or other users. The nature and volume of advertisements displayed on the Website are determined and may be changed at the sole discretion of the Website Administration.
Correspondence and business dealings with advertisers or participation in promotions conducted by advertisers, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between the User and the advertiser. The User agrees that the Website Administration is not responsible or liable for any losses or damages incurred as a result of such dealings or the presence of advertisements on the Website.


3. Registration

To gain access to all features of the Website, the User must complete the registration procedure. Registration is carried out by following a series of steps to fill out an electronic registration form, as a result of which the individual becomes a registered User and receives a unique login and password to access all available features of the Website.

The Website Administration reserves the right to block and/or delete a User's Profile, deny access to all or certain features of the Website, and delete User Information without explanation. This includes, but is not limited to, cases where the User violates the terms of this Agreement, provides false information about themselves, or if the Website Administration has reason to believe that the information provided is inaccurate, incomplete, misleading, violates the terms of this Agreement, or the User is using someone else’s information.


4. Authorization

Each registered User has a unique login and password required for authorization on the Website. These individual login credentials are intended solely for use by the registered User.

The User agrees not to disclose or transfer their login and password to third parties and must take all necessary measures to ensure that their login and password are not accessible to others. The individual login and/or password grant access to sections of the Website that are available only to registered Users, as well as to personal pages intended solely for that User.

If any person other than the User logs into the Website using the User’s login and password, all actions performed by such person shall be deemed to have been performed by the User. The User is solely responsible for all actions taken on the Website by themself, as well as for all actions performed on the Website by any third party using the User’s login and password.

The registered User is solely responsible for maintaining the confidentiality and security of their login and password and for all consequences that may result from their unauthorized and/or other improper use.

In the event of unauthorized use of their login or password, or suspicion thereof, as well as any violations or suspected violations of account security, the User must immediately notify the Website Administration.

The Website Administration is not responsible for any potential loss or corruption of Information that may occur due to the User’s violation of this section of the Agreement.


5. User’s Personal Information

The Website Administration, when processing the User’s Personal Information, undertakes to take all organizational and technical measures necessary to protect the User’s Personal Information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other unlawful actions by third parties. However, it is not excluded that, due to a website malfunction, virus or hacker attack, technical failure, or other circumstances, the User’s Personal Information may become accessible to third parties. The User understands this and agrees not to make any claims against the Website Administration in this regard.

Although the Website Administration requires only a minimum amount of information during registration and authorization, the User may, at their own discretion and will, add personal data. The User agrees that any Personal Information they provide in their Profile is publicly accessible and may be viewed by any other User of the Website.

The User agrees that the Website Administration collects, stores, and otherwise processes the User’s Personal Information for the following purposes:

Identification of the party within the framework of agreements and contracts with the Website Administration;

Sending notifications, messages, and information related to the use of the Website;

Communication with the User for the purpose of providing services, as well as handling requests and applications from the User;

Improving the quality and usability of the Website, and developing new services and features;

Targeting of advertising materials;

Conducting statistical and other research based on anonymized User data.

The User confirms that, by posting their Personal Information on the Website, they do so voluntarily and that they voluntarily provide this Information to the Website Administration. The Website Administration does not intend to collect information considered personal data under applicable law, except in cases where such information is voluntarily provided by the User. By voluntarily providing their personal data, the User consents to the processing of their personal data, including its transfer and processing in accordance with applicable law. If the User does not wish for their personal data to be processed, they should refrain from providing it on the Website.

The User undertakes not to post on the Website the personal data of third parties without their consent and/or use the personal data of other Users in any manner inconsistent with applicable law, for unlawful and/or illegal purposes, or for any other purposes not aligned with the intended use of the Website.

The User has the right at any time to change and/or supplement their Personal Information or any part thereof, provided such changes do not violate the terms of this Agreement.

The User has the right to delete the Personal Information they have provided in their Profile by contacting the Website Administration through the Feedback form. This action may limit the User’s access to certain features and sections of the Website.

The Website Administration shall not be liable for the use of the User’s Personal Information by third parties, including those to whom such Personal Information was transferred by the Website Administration in accordance with clause 5.9 of this Agreement.

Without prejudice to other provisions of this Agreement, the Website Administration has the right to transfer the User’s Personal Information to third parties in the following cases:

The User has given their consent to such transfer;

The transfer is necessary for the User's use of the Website or for the provision of services to the User;

The transfer is required under applicable legal procedures;

The transfer occurs in the context of the sale or other transfer of the business (in whole or in part), whereby all obligations to comply with the terms of this Agreement regarding the User's Personal Information are transferred to the purchaser;

To protect the rights and legitimate interests of the Website Administration or third parties in cases where the User violates the terms of this Agreement;

The transfer occurs between parties affiliated with the Website Administration. In this case, all obligations to comply with the terms of this Agreement regarding the User's Personal Information are also transferred to the recipient.

6. Content Posting

6.1. The User agrees that they bear sole responsibility for any materials publicly posted on the Website or confidentially transmitted through the technical means provided by the Website. By accepting these Rules, the User confirms that they possess all intellectual property rights to the User Content and grants the Company the right to use, copy, create derivative works from, distribute, publicly display and perform, store, transmit, send, and publish the User Content and any subsequent edits for the following purposes:

(i) displaying the User Content on the Website;
(ii) distributing the User Content by electronic or other means to enable other users to download or otherwise access such content;
(iii) storing the User Content in a remote database accessible by other users.

If the User does not have the appropriate rights to post any Information on the Website, they agree not to post such Information.

6.2. When using the Website, Users may encounter content that could be harmful, offensive, obscene, or inaccurate. The User accepts all risks associated with the use of such content. The Website Administration reserves the right to remove any content that violates this User Agreement or is offensive but does not assume any obligation to do so.

6.3. When using the Website, the User agrees to:

Refrain from actions that may disrupt the proper functioning of the Website.
Not post or transmit via the Website any Information that:

contains threats, defamation, or insults;

discredits the honor and/or dignity of third parties;

violates the rights and legally protected interests of third parties, including copyright;

infringes on individuals' right to privacy or disrupts public order;

promotes or contains discrimination based on race, ethnicity, gender, age, religion, social status, sexual orientation, political beliefs, or other grounds;

incites or advocates for the overthrow of the constitutional order, war, religious, racial, or ethnic hatred, or the infringement of minority rights;

promotes hostility or incites violence;

contains pornographic or otherwise immoral materials;

contains extremist materials;

offends religious feelings;

is knowingly false or misleading;

is intended solely to generate traffic to external websites;

includes links to full game versions or leaked beta versions.

Not deliberately flood sections of the Website with useless or non-informative messages, repeated characters, identical posts, oversized images or special characters, excessive use of formatting (e.g. Caps Lock, transliteration), or any other methods that disturb other users or distort the Website layout.

Not post "commissioned" Information created in someone’s interest that contradicts the goals of the Website.

Not post any Information that violates applicable laws and/or this Agreement.

Refrain from publicly criticizing the Administration (including moderators as its representatives), questioning moderation or administration decisions, or arguing with moderators or administrators.

Not post or distribute any malicious software (viruses, trojans, worms, etc.) or any files, codes, or programs designed to disrupt, modify, block, destroy, or limit the functionality of any computer or telecommunications equipment or software, or that enable unauthorized access.

Not distribute or use bots, crawlers, or other automated systems to extract, transfer, copy, block, modify, or destroy Information or Databases, or to circumvent restrictions imposed by the Website Administration.

Not post any advertising materials without prior consent from the Website Administration.

Not post or use any Information protected by intellectual property law (including but not limited to patents, trademarks, copyrights) without the proper rights or authorization. In case of dispute, the User bears the burden of proof that such Information does not infringe on any rights.

Not collect, store, distribute, process, or otherwise use Personal Information of other Users.

Not post links to websites that violate applicable laws and/or this Agreement.

Evaluate the legality of any materials (including images of others, third-party texts, audio, video) before posting them on the Website.

Not distribute spam, chain letters, "get rich quick" schemes, pyramid schemes, multi-level marketing (MLM), or email-business systems.

Not assist or engage in any unlawful activity using the Website, or in any manner that contradicts applicable laws and/or this Agreement.

Not post content aimed at extorting or soliciting money from other Users or third parties for any reason.

The Website Administration does not verify, nor has the technical or factual ability to verify, all Information posted by Users for compliance with applicable laws and this Agreement. Such verification would make the operation of the Website impossible. However, the Administration may perform such checks at its sole discretion if concerns arise.

The Website Administration provides the User with the ability to post Information on the Website but assumes no responsibility for the accuracy or legality of such User-submitted Information.

Links to other websites, products, services, or commercial/non-commercial content posted by the User or in the form of advertising on the Website do not constitute endorsement or recommendation by the Website Administration.

The Website Administration reserves the right, at its sole discretion, to reject or remove any Information that the User intends to post or has already posted on the Website.


7. Use of the Website

The User may use the Website only in accordance with this Agreement and solely in the ways provided by the technical capabilities of the Website.

The Website may contain links to websites owned by third parties, which may be of a commercial nature. The inclusion of third-party content and links to third-party websites on the Website does not constitute an endorsement of such content or websites. The Website Administration is not responsible for the content of such websites or any content hosted on them. Furthermore, the Website Administration is not responsible for any goods or services offered through links to third-party websites.

Any interaction with third parties, including transactions involving payment, delivery of goods, or provision of services, is carried out by the User independently. The Website Administration bears no responsibility and assumes no obligations in the event of any loss or damage of any kind resulting from such transactions between the User and third parties. Any questions, legal claims, or complaints regarding any goods or services must be addressed to the relevant vendor.


8. Liability

The Website Administration makes commercially reasonable efforts to ensure the Website operates on a 24/7 basis; however, it does not guarantee the absence of interruptions related to technical malfunctions, maintenance work, or the full or partial operability of the Website/Service.

The User hereby confirms their agreement to indemnify, defend, and hold harmless the Website Administration and all of our officers, directors, owners, employees, agents, information providers, affiliated companies, partners, and licensors (collectively referred to as the "Partners") from and against any liability, damage, expense, or cost (including attorneys’ fees) incurred by any party in connection with any claim, including, but not limited to, claims for defamation, violation of publicity rights and/or invasion of privacy, copyright or trademark infringement, arising from:

the use of the Website;

any use or alleged use of the User's account and password by any person, whether or not authorized by the User;

the content, quality, or nature of the materials posted by the User on the Website;

the User’s violation of this Agreement or the User’s violation of the rights of any third party, whether individual or legal entity.

The Website Administration does not guarantee that the information posted on the Website will be available at all times or will not be deleted or lost. The Website Administration shall not be held liable for any failures or delays in the operation of the Website or for any possible consequences arising from such failures or delays.

The Website Administration is not responsible for any offensive, knowingly false, or misleading information, or for any other information that violates applicable laws and is posted by third parties. However, the Website Administration undertakes all possible efforts to remove such information from the Website upon receiving a complaint from rights holders or Users. Responsibility for such information lies with the individuals who posted it.

All information published on the Website, including the layout and design of the Website, is provided “as is.” The Website Administration disclaims any warranties that the Website is or will be suitable for specific purposes of use.

In the event that third parties make claims against the Website Administration in connection with the User’s use of the Website, the User agrees to independently settle such claims and hold the Website Administration harmless from any losses or legal disputes that may arise.


9. Miscellaneous

This Agreement shall be governed by and construed in accordance with the applicable legislation. Any issues not regulated by this Agreement shall be resolved in accordance with the applicable legislation. All disputes arising from the relationships governed by this Agreement shall be resolved in the manner prescribed by the applicable legislation. Throughout this Agreement, unless explicitly stated otherwise, the term “legislation” shall be interpreted as the applicable legislation.

The User and the Website Administration shall make every effort to resolve any disputes and disagreements between them through negotiation. If the parties fail to resolve the disputes through negotiation, such disputes shall be submitted to the competent court for consideration.

Nothing in this Agreement shall be construed as establishing agency relationships, joint venture, employment, or any other relationship not expressly stipulated herein between the User and the Website Administration.

If any provision of this Agreement is held by a court to be invalid or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions of the Agreement.

This Agreement is made in the Russian language and, in some cases, may be provided to the User in another language for informational purposes. In the event of any discrepancies between the Russian version of the Agreement and a version in another language, the provisions of the Russian version shall prevail.

If the Website Administration fails to act in response to a violation of this Agreement by the User or other Users, this shall not be considered a waiver of its rights to take appropriate action in the future in protection of its interests. Such inaction does not waive the Website Administration’s right to respond to similar and/or repeated violations in the future.

This Agreement may be modified by the Website Administration at any time without any specific notice. The updated version of the Agreement shall take effect upon its publication on the Internet, unless otherwise specified in the new version. If the User continues to use the Website after the updated Agreement has taken effect, such continued use constitutes the User’s acceptance of the changes. If at any time the User is no longer able to comply with the terms of the Agreement, the User must immediately stop using the Website.

The Website Administration may also impose restrictions on certain features or services, or limit the User’s access to the Website or parts of it without prior notice and without liability, for technical or security reasons, to prevent unauthorized access, data loss, or destruction, or if the Website Administration, at its sole discretion, believes the User is violating this Agreement or any applicable law.

For the User: the email address provided in the User's profile or the email address provided when submitting a request through the contact form.

This Agreement constitutes a public offer. The User’s acceptance of the terms of this Agreement shall be deemed as their actual use of the Website, its services, and any information posted on it.
